India · accounts frozen after a cyber-fraud complaint

Bank account frozen by a cyber cell?

If fraud money passed through your account, even unknowingly, police can freeze it. Since January 2026 the Home Ministry's SOP says a freeze should be limited to the disputed amount, and gives you a complaint route with a 15-day escalation. Most people don't know it exists.

How account freezes work, and how to get yours lifted

When someone reports cyber fraud on cybercrime.gov.in or the 1930 helpline, the system traces where the money went and the police ask each bank on the trail to put a lien on it. If a payment passed through your account, yours gets frozen too, even if you sold something honestly and had no idea.

  1. Ask the bank who froze it. Many banks only say "police request". You need the police station, state and reference to do anything.
  2. Write to the district grievance officer. Under the MHA SOP of January 2026, an Additional or Deputy Superintendent of Police in each district handles grievances about freezes. Explain where the money came from and ask for the lien to be limited to the disputed amount.
  3. No reply in 15 days? The grievance goes up to the District Grievance Redressal Officer. State-level oversight sits with an officer of DG or IG rank.
  4. Still stuck? High Courts in several states have ordered banks to unfreeze accounts beyond the disputed amount. A lawyer can file a writ petition, and free legal aid is available through your District Legal Services Authority.
Can they freeze my whole account for a small amount?

The SOP says a lien should be limited to the disputed amount, with a full freeze as the exception. Courts have said the same: recent rulings from the Rajasthan, Madhya Pradesh and Allahabad High Courts went against blanket freezes.

How long can the freeze last?

Reports of the SOP say banks should lift a freeze within 90 days if no court order is in place, and that frauds under ₹50,000 can be refunded without a court order. Larger amounts can stay on hold until the investigation ends or a court decides.

Should I pay an agent to unfreeze it?

Be careful. Anyone promising to unfreeze an account for a fee, especially by "settling" with police, may be a scammer. The letters here are the official route, and legal aid is free.

Is this legal advice?

No. It's legal information and letter templates based on published reports of the SOP and recent High Court judgments. For your own case, contact a lawyer or your District Legal Services Authority.
